New Delhi – In a move to enhance road safety across India, the Ministry of Road Transport and Highways has announced a new rule mandating two BIS-certified helmets to be provided with every new two-wheeler sold in the country. One helmet is meant for the rider and the other for the pillion passenger.
What Does the New Rule Say?
As per the draft notification issued on June 23, 2025, manufacturers must now include two helmets along with every new bike or scooter at the time of delivery. The rule is part of an amendment to the Central Motor Vehicles Rules, 1989, and will be effective three months after it is published in the official gazette.
Focus on Helmet Usage
Two-wheeler riders account for a large share of road accident fatalities in India. Most pillion passengers do not wear helmets, despite the risks. The government aims to change that by making it mandatory to supply two BIS-certified helmets with new vehicles.
ABS Braking System Also Mandatory
From January 1, 2026, all new two-wheelers under the L2 category must also be equipped with Anti-lock Braking Systems (ABS). This is aimed at reducing accidents caused by wheel lock during emergency braking.
What Are L2 Category Vehicles?
- Vehicles with engine capacity over 50cc
- Or with a top speed of more than 50 km/h
Who Is Exempt?
Some exemptions will apply under Section 129 of the Motor Vehicles Act, including certain categories of commercial or special-use vehicles.
Public Feedback Invited
The government has opened the rule for public feedback for 30 days. Suggestions can be emailed to comments-morth@gov.in by July 23, 2025.
